Repeatedly letting a condominium flat designated as a residence to tourists for short stays changes its designated use, according to settled Austrian Supreme Court case law. This requires the consent of all other flat owners or approval by the district court. Without either, co-owners can sue for an injunction. No new consent is needed if the condominium agreement already allows tourist letting.
